Martha advises banks and other financial institutions on all aspects of consumer financial regulatory compliance, including the statutory and regulatory requirements related to fair lending/fair servicing (including evaluation of compliance management systems and assistance with targeted fair lending regulatory examinations and fair lending enforcement actions); truth in lending (including loan originator compensation and QM/ATR); the Real Estate Settlement Procedures Act (including TILA-RESPA Integrated Disclosure, Section 8 issues, and the CFPB's mortgage servicing rules); the Equal Credit Opportunity Act; the Home Mortgage Disclosure Act; the Community Reinvestment Act; the Fair Debt Collection Practices Act; the Fair Credit Reporting Act; unfair, deceptive, or abusive acts or practices; and E-Signature issues, as well as vendor management and financial privacy concerns. Martha also provides training to clients on fair lending and new regulatory issues, helps clients prepare for regulatory examinations, assists clients with state licensure matters, and drafts and negotiates related contracts and agreements. 

Martha has also advised the Monitor of the National Mortgage Settlement (NMS), Joseph A. Smith, Jr., regarding interpretation and implementation of the NMS Consent Judgment, whose parties have included seven major mortgage servicers (including the four largest banking organizations in the United States), the United States Government and 49 states.

Martha writes and speaks on mortgage banking-related issues, and has been invited to speak by the American Conference Institute, the UNC School of Law Banking Institute, the American Mortgage Conference, the North Carolina Bankers Association and the Mortgage Bankers Association of the Carolinas.  Martha is also an Industry Author for Mortgage Compliance Magazine. 

Other Representative Experience

Martha's first career began in the Silicon Valley, CA high-technology audit practice of the "big-4" accounting firm Price Waterhouse. She has nearly 20 years of hands-on business experience, including various management- and executive-level positions involving oversight of accounting, budgeting, tax and treasury, and contract negotiation functions. Martha's breadth of experience enables her legal analysis of issues to be informed by a practical business sensibility.

Martha also has in-house legal experience working for both federally and state-chartered credit unions.

Martha is a Certified Public Accountant (California, inactive).
