While Poyner Spruill has a long and distinguished history of representing insurance carriers and businesses of all kinds in defense of tort cases, Poyner Spruill also represents individuals in prosecuting these cases. Poyner Spruill does not initiate contact with injured individuals or aggrieved families in any way. We have, however, quietly built a reputation as extremely effective and respected Plaintiff’s personal injury and wrongful death counsel in selective cases. We firmly believe that all our tort litigation clients, including individuals and insurance carriers and businesses, benefit from our extensive knowledge and experience gained through both sides of this practice. 

Our attorneys represent Plaintiffs in a wide range of cases, including catastrophic motor vehicle accidents, complex premises liability claims, products liability, worker’s compensation claims, and intentional torts such as malicious prosecution and assault and battery. We have successfully represented Plaintiffs as both lead counsel and in association with other firms, who occasionally retain us in particularly complex, novel, or large cases. 

We regularly appear on behalf of clients in all North Carolina state and federal trial and appellate courts. Our attorneys have tried cases in all three districts of the federal trial court in North Carolina and in most of the 100 counties in the North Carolina state court system. 

Our attorneys also regularly appear before the North Carolina Court of Appeals, the North Carolina Supreme Court, and the United States Court of Appeals for the Fourth Circuit. The firm is also experienced in the utilization of all forms of alternative dispute resolution (ADR), including binding and non-binding arbitration, voluntary and court-ordered mediation, and unmediated settlement conferences. 

Some specific recent examples of our representation of Plaintiffs in tort cases are as follows: 

  • After filing suit and pursuing extensive discovery, we obtained a settlement of $5.9 Million for a minor and her family resulting from a near-drowning incident at a pool owned by the developer of a gated community in western North Carolina. There was only $5.3 Million in insurance coverage.
  • Representation of an estate in a wrongful death claim against a national corporation whose truck driver was grossly negligent in causing a motor vehicle wreck. We overcame the company’s argument that its driver had stolen the truck and was acting outside the course and scope of his employment, uncovering similar previous incidents, and eventually settling the case for several million dollars.
  • Representation of a bicyclist who suffered a traumatic leg amputation when struck by a pick-up truck pulling a utility trailer
  • Representation of a pedestrian seriously injured by an intoxicated driver resulting in a major settlement with both the driver and the bar that served him in a “Dram Shop” case
  • We negotiated a $1.2 Million dollar settlement for a plaintiff severely injured when her car was struck by a large truck carrying asphalt.
  • We represented an individual who sustained severe injuries when an apartment balcony collapsed. We filed suit against the contractor that improperly secured the balcony railing and overcame a contributory negligence defense. After a week of trial, we accepted the Defendant’s greatly increased settlement offer.
  • Representation of an individual who suffered catastrophic injuries in a motor vehicle accident while working. We represented our client both in his worker’s compensation claim and in his third-party liability claim, guiding the client through complex issues of underinsured motorist insurance coverage and subrogation and lien law.
