Representative Experience

Represents numerous municipalities and industrial clients in obtaining and defending permits for wastewater treatment plants, solid waste landfills and other municipal facilities.  Have worked with BFI, several counties and private landowners in obtaining the necessary regulatory approvals for landfills and or related legal and compliance matters

Represents industrial clients in negotiating and litigating scope of liability, response obligations, remediation, and contribution actions under Superfund and State laws regarding hazardous substances and petroleum releases

Represented major lender in designing and implementing environmental due diligence requirements for borrower and in analyzing environmental risks to a lender for a $50 million refinance of convenience stores

Counsels major lenders in developing environmental due diligence requirements for borrowers and training loan officers

Represents developers and lenders in analyzing environmental risks for major construction projects and loan transactions

Counsels property owners and major developers regarding wetlands, stormwater compliance, wastewater treatment permits, and coastal development issues

Has written manual for municipal clients regarding environmental due diligence in acquiring property and aided in training personnel

Counsels major public and private developers regarding Environmental Impact Statement requirements

Represents municipal clients in obtaining and defending permission for interbasin transfers of water

Legal Counsel to the Lower Neuse River Basin Association and Neuse River Compliance Association, formed voluntarily by point source dischargers to promote nutrient reduction in the Neuse River

Represents major international airport regarding environmental compliance matters
