Profile

Jason focuses his practice primarily in the areas of commercial and business tort litigation, construction litigation, and commercial landlord and tenant litigation.  Jason brings experience in many disciplines to his representation of business clients.  He has litigated disputes involving complex commercial issues, including trade secrets violations and unfair and deceptive trade practice cases involving multi-million dollar claims.  In his construction practice, Jason represents general contractors, subcontractors, material suppliers, as well as owners and developers in disputes ranging from defect and delay claims, performance issues, wrongful termination claims, and liability disputes.   Jason also has significant experience representing both commercial landlords and tenants in lease disputes, as well as commercial lease negotiations.

Welliver McGuire, Inc. v. Members Interior Construction, Inc. (Mecklenburg County Superior Court)

  • Counsel for HD Supply (formerly Hughes Supply, Inc.) in products liability case.

ContraVest Const. Co. v. Humphreys & Partners Architects, L.P., et al. (Mecklenburg County Superior Court) 

  • Counsel for ContraVest in a construction defect case involving stairway landings at an apartment complex.

Course Doctors, Inc. v. Mountaineer Land Group, LLC  (North Carolina Business Court). 

  • Counsel for subcontractor in matter involving failed multi-million dollar golf course project in Mecklenburg and Cabarrus County.

Nationwide Mut. Ins. Co. v. Haight, 152 N.C. App. 137, 566 S.E.2d 835 (2002).

  • Counsel for underinsured motorist insurer. Successfully argued that the proper calculation of UIM coverage available is obtained by subtracting the per-accident limit of the tortfeasor’s liability policy from the per-accident limit of the UIM policy.

Moose v. Versailles Condominium Assoc., et. al., (614 S.E.2d 418; 2005 N.C. App. LEXIS 1199 (2005))

  • Counsel for Condominium Association and Management Association in action brought by individual condominium owners for breach of contract and breach of fiduciary duty. Filed interlocutory appeal on behalf of Management Association from Order denying Defendant’s Motion to Compel Arbitration which was filed after Plaintiffs filed an Amended Complaint.
