Jenny has been an associate in the firm's litigation section since 2005 and practices in both federal and state court. While a large part of her practice focuses on representing insurance companies and their insureds in negligence actions, she has worked on a wide range of civil lawsuits, including fraud, wrongful death, construction, contract and land condemnation actions. Jenny has experience in all phases of litigation, including preparing pleadings and motions, conducting discovery, trying cases, and arguing in the North Carolina Court of Appeals.
Representative Experience
City of Wilson Redevelopment Commission v. Boykin et al., 667 S.E.2d 282 (N.C. App. 2008) - We represented two of the owners of a house in Wilson, North Carolina which was being condemned by the City's Redevelopment Commission because it was "blighted and substandard" and located in a neighborhood with "very high crime rates." The Commission's expert witness, a real estate appraiser, testified that he thought the fair market value of the property was $45,000. One owner of the house testified that she thought the fair market value of the property was $85,000, and our client testified that the fair market value was $150,000. The jury returned a verdict of $170,000. The trial court and the North Carolina Court of Appeals upheld the verdict after it was voluntarily remitted by our clients to $150,000.
Garrett v. Parton et al., (North Carolina Business Court 2008) - Plaintiff, a taxpayer in the City of Roanoke Rapids who was represented by the North Carolina Institute for Constitutional Law, filed suit against Randy Parton and other defendants, alleging civil conspiracy, breach of fiduciary duty, common law fraud, tortious acting in concert, unfair and deceptive trade practices, fraudulent misrepresentation, and negligent misrepresentation. We had the case designated as a mandatory complex business case and moved to dismiss for lack of standing. The Business Court found that Plaintiff had neither individual nor derivative taxpayer standing and dismissed the case in its entirety.
