The Bankruptcy and Creditors' Rights Section regularly represents secured and unsecured creditors, including banks, factors, insurance companies, manufacturers and other business clients in bankruptcy and workout matters. The attorneys practicing in this area regularly appear in the Bankruptcy Courts of each North Carolina District and in other states, as well as represent creditors in business and consumer cases under Chapters 7, 11, 12 and 13.  Our practice also includes representation of business debtors in workouts and restructurings and in cases filed in Chapters 7 and 11.

 

Section attorneys are experienced in dealing with all bankruptcy appeals, workouts and other creditor-oriented issues such as reclamation, consignment, UCC issues, and receiverships in state and federal court. They also have extensive experience in representing bankruptcy trustees and committees of unsecured creditors and equity holders. Section attorneys team with Banking, Credit and Financial Services Section attorneys to handle workouts and restructurings outside of bankruptcy court for both debtors and creditors.  

 

In the area of debtor representation, our attorneys handle both large, complex cases involving publicly traded companies, as well as smaller cases involving closely held corporations.  While business debtor representation is primarily based in the Carolinas, a nationwide network of contacts enables Section attorneys to respond to bankruptcies wherever they arise for clients with multi-state business interests.
