Biography
Dylan’s eminent domain practice is focused on the representation of property owners in land condemnation actions initiated by public and private condemnors. He routinely handles matters arising from transportation, utility, and public‑infrastructure projects in which the core issues extend beyond simple land acquisition and involve the assertion of advanced damages theories, particularly in reference to severance damages in partial takings.
On average, Dylan has recovered four times the initial offer on behalf of his clients in condemnation cases.[1] Recent results include the following:
- More than 10x the initial offer for vacant land with residential development potential.
- More than 5x the initial offer for a commercial property.
- More than 4x the initial offer for vacant land with commercial development potential.
Dylan advises clients facing both partial and total takings through all stages of the condemnation process and resulting litigation. He works closely with his clients and experts, including appraisers, engineers, and planners, to identify, quantify, and present legal arguments and evidence reflecting the full compensable impact of the taking. He is experienced in addressing and highlighting damages to the remainder of the property in the “after” condition.
Dylan also represents property owners in inverse condemnation cases arising from government actions that result in compensable damage without a formal taking, as well as disputes involving private condemnors whose projects affect residential, agricultural, and commercial properties.
In addition to his eminent domain practice, Dylan has represented clients in state and federal court on a variety of civil matters, including business disputes, insurance coverage, and municipal litigation. Dylan serves as counsel for a local board of adjustment in quasi‑judicial hearings for special use permits, variance requests, and appeals taken from administrative zoning decisions. Before joining the firm, he clerked for the Honorable Richard A. Elmore at the North Carolina Court of Appeals.
