CBD Oil and Marijuana: Employment Law Considerations for Employees and Applicants
With the rise in popularity of CBD oil and conflicting laws on the legalization of marijuana, employers have a lot of questions about the effect of these changes on their workforce. This presentation will focus on best practices in hiring, discipline, and drug testing under North Carolina and federal law. We will focus on the legal status of CBD oil and marijuana, and will also discuss employers’ rights when it comes to regulating on-duty and off-duty use by employees.
Topics addressed will include:
- What is CBD oil and is its use legal under federal and state (NC) law?
- What is the legal status of marijuana use?
- Will CBD oil show up on drug tests and when can employers test for CBD oil or marijuana use?
- Can employers fire or discipline an employee for using CBD oil, medical marijuana, or recreational marijuana (in states where recreational use is legal)?
- Summary of best practices for NC employers, including how to address CBD oil and marijuana in drug testing policies.
Fair Labor Standards Act Compliance Update
This half-hour presentation will include:
- Explanation of and strategies for complying with the new minimum salary requirements for exempt positions established by the US Department of Labor;
- Enforcement trends for both US DOL actions and class and collective lawsuits by current and former employees;
- Case law update on district, circuit, and US Supreme Court cases involving FLSA and wage and hour issues; and
- Common litigation issues and risk management strategies, including joint employer standards, off the clock and training and travel time issues, and misclassification and joint employer problems.
Managing Risks in Retirement Plans and other Hot Topics
Benefit plans are incredibly important in attracting and retaining employees, but they come with inherent liability for the company that sponsors them. This session will review the sources of that liability and discuss practical ways in-house counsel can add value by managing that liability. Counsel will gain a better understanding of the broad legal landscape impacting their company’s benefit plans, be able to identify major sources of liability associated with those plans, and discuss the practical steps they, as in-house counsel, can take to help manage that liability.
Immigration Update: No-Match Letters and ICE I-9 Notices of Inspection
After almost a decade long hiatus, the Social Security Administration has resumed sending employers no-match letters advising the employer that an employee’s name and social security number do not match. Attendees will learn what steps to take and how to respond. Additionally, ICE issued 5,200 Notices of Inspection of employers’ I-9 records within a six month period. We will cover how to prepare for and respond to ICE.
Ethical Issues in Investigations
In-house counsel are called upon to conduct investigations on a variety of topics. Ethical issues often arise, and in-house counsel need to know when to spot them and how to deal with them. This seminar will discuss ethical issues relating to the following:
- Who is the client
- When to use an Upjohn warning to clarify who you do (and don’t) represent and who holds the attorney client privilege
- Joint representation and conflicts
- Preserving the attorney client privilege in investigations that may be used as a “shield”
OFCCP issued an unprecedented number of Corporate Scheduling Letters this year. In addition, OFCCP has also issued many new Directives, changing the way audits are to be conducted, and has increased focus on veteran and IWD issues.
